These General Terms & Conditions (“Terms”) govern all services provided by Bull God Lawn Care (“Contractor,” “we,” or “us”) to any client (“Client” or “you”). By requesting, scheduling, approving, paying for, or otherwise permitting services to be performed, the Client agrees to be bound by these Terms.

1. Services Provided

Bull God Lawn Care will provide landscaping, property maintenance, and related services (collectively, the “Services”) as requested by the Client and described in applicable proposals, estimates, invoices, service schedules, work orders, or online service requests.

Service descriptions are general in nature. Unless expressly stated otherwise in writing, the Contractor retains discretion over the methods, materials, equipment, sequencing, and scope reasonably necessary to perform the Services.

2. Pricing & Payment Terms

All pricing for Services will be communicated to the Client prior to or in connection with performance of the Services, where practicable.

Payment Terms

Unless otherwise agreed in writing, payment is due net fourteen (14) days from the invoice date. Payment must be made in full unless a partial payment arrangement is expressly approved in writing by Bull God Lawn Care.

Failure to remit payment by the due date constitutes non-payment.

Unquoted or Time-and-Materials Services

In some instances, the Client may request Services without a written quote or agreed fixed price. In such cases, the Services will be performed on a time and materials basis.

Unless otherwise agreed in writing, unquoted Services will be billed at a rate of $85 per labor hour, per crew member, with a one (1) hour minimum per visit.

Requesting, authorizing, or permitting such work—whether verbally, electronically, or by conduct—constitutes the Client’s approval of this billing rate and minimum.

Suspension or Termination for Non-Payment

If an invoice becomes past due, Bull God Lawn Care may, in its sole discretion, suspend or terminate Services until the account is brought current. Suspension or termination of Services does not relieve the Client of the obligation to pay any outstanding balances.

Payment Methods

Accepted payment methods include:

Debit Card
Credit Card
ACH (via online payment portal)
Check payable to Bull God Lawn Care\n

Card Authorization

Bull God Lawn Care utilizes third-party payment processors for card and electronic payments and does not store or retain the Client’s payment information. By submitting payment, the Client authorizes the processor to charge the approved payment method for Services rendered.

Invoice Disputes and Withholding of Payment

The Client must notify Bull God Lawn Care in writing of any dispute regarding an invoice within fourteen (14) days of the invoice date. Failure to do so constitutes acceptance of the invoice as issued.

The Client may not withhold payment for undisputed portions of an invoice. Payment may not be withheld due to minor, unrelated, or previously addressed issues.

Chargebacks

Chargebacks or payment reversals are prohibited for Services that have been performed. Initiating a chargeback for completed Services, absent fraud, constitutes a material breach of these Terms.

Collections, Arbitration, and Enforcement Costs

If arbitration or legal action becomes necessary to enforce payment, the Client shall be responsible for all costs incurred by Bull God Lawn Care, including attorney’s fees, arbitration fees, court costs, and administrative expenses.

Such costs shall include an additional enforcement fee equal to ten percent (10%) of the outstanding balance or one hundred fifty dollars ($150), whichever is greater, to the extent permitted by law.

Application of Payments

All payments received will be applied to the oldest outstanding balance, unless otherwise designated for a specific invoice.

3. Termination

Client Termination

The Client may cancel Services by providing three (3) days’ written notice to hello@bullgod.com. The Client remains responsible for payment for all Services performed and expenses incurred up to the effective date of cancellation. Any prepaid but unused Services will be prorated where applicable.

Contractor Termination

Bull God Lawn Care may suspend or terminate Services at any time, with or without cause, upon written or electronic notice to the Client. Grounds for termination may include, but are not limited to, non-payment, unsafe site conditions, lack of access, or operational constraints.

Termination or suspension of Services does not relieve the Client of the obligation to pay any outstanding balances or amounts owed for Services already performed.

4. Insurance & Limitation of Liability

Bull God Lawn Care maintains commercial general liability insurance covering damages directly caused by the Contractor during the active performance of Services, subject to the terms, conditions, and limitations of the applicable policy.

Limitation of Liability

To the fullest extent permitted by law, Bull God Lawn Care shall not be liable for:

Pre-existing conditions on the property
Hidden, unmarked, or underground utilities, irrigation lines, piping, wiring, or structures
Damage resulting from soil conditions, frost, weather, drainage issues, erosion, or normal wear and tear
Damage to lawns, turf, curbing, pavement, hardscapes, landscaping, or fixtures resulting from normal landscaping, maintenance, snow removal, or de-icing operations
Damage caused by conditions outside the Contractor’s reasonable control

The Client acknowledges that landscaping, property maintenance, and snow or ice management services inherently involve the use of heavy equipment and materials and that some incidental impact may occur despite reasonable care.

Client Responsibilities

The Client is responsible for:

Clearly marking or disclosing underground utilities, private lines, irrigation systems, or sensitive areas
Maintaining adequate property and liability insurance
Ensuring the property is reasonably accessible and safe

Bull God Lawn Care shall not be responsible for damage resulting from the Client’s failure to meet these responsibilities.

No Guarantee of Conditions

Services are performed using commercially reasonable efforts consistent with generally accepted industry practices. The Contractor does not guarantee specific outcomes related to turf health, plant survival, soil conditions, surface conditions, or the complete elimination of snow or ice.

5. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services provided (a “Dispute”) shall be resolved through binding arbitration, unless otherwise stated below.

Venue & Governing Law

Arbitration shall take place in Worcester County, Massachusetts, and shall be governed by the laws of the Commonwealth of Massachusetts.

Waiver of Court Trial

Both parties knowingly and voluntarily waive the right to a trial before a judge or jury for any Dispute subject to arbitration.

Exceptions

Either party may:

Pursue a claim in small claims court, where permitted by law, or
Seek injunctive or equitable relief to prevent immediate or irreparable harm

Costs and Fees

As provided in these Terms, the Client shall be responsible for all costs incurred by Bull God Lawn Care to enforce payment or resolve a Dispute, to the fullest extent permitted by law.

Survival

This section survives the completion, suspension, or termination of the Services.

6. Subcontractors

Bull God Lawn Care may, at its discretion, utilize subcontractors to perform some or all of the Services. Any subcontractors engaged by Bull God Lawn Care will be properly insured as required for the Services performed.

The Client may not directly hire, contract with, or pay any subcontractor performing Services on behalf of Bull God Lawn Care without prior written consent.

The use of subcontractors does not relieve Bull God Lawn Care of its obligations under these Terms.

7. Force Majeure

Bull God Lawn Care shall not be deemed in breach of these Terms, nor liable for delay, suspension, or failure to perform the Services, where such delay or failure is caused by events beyond its reasonable control (“Force Majeure Events”).

Force Majeure Events include, but are not limited to severe or unusual weather conditions, natural disasters, equipment failure despite reasonable maintenance, supply chain disruptions, labor shortages or illness, government orders, emergencies, regulatory actions, or unsafe site conditions.

Performance shall resume as soon as practicable once the Force Majeure Event has ended. Force Majeure Events do not relieve the Client of the obligation to pay for Services already performed.

8. Photography & Marketing

The Client grants Bull God Lawn Care permission to photograph, video record, or otherwise document the Client’s property before, during, or after performance of the Services for documentation, quality control, marketing, and promotional purposes.

No compensation will be provided. The Client may revoke this permission by providing written notice to hello@bullgod.com; however, revocation applies prospectively only and does not affect materials created prior to receipt of such notice.

Bull God Lawn Care will not intentionally identify the Client by name or disclose personal information in marketing materials without consent.

9. Confidentiality

Each party agrees to keep confidential any non-public, proprietary, or sensitive information disclosed in connection with the Services.

Confidential information does not include information that is publicly available, independently developed, or required to be disclosed by law. This obligation survives termination of the Services.

10. Entire Agreement & Updates

These Terms, together with any applicable service-specific addenda, constitute the entire agreement between the parties regarding the Services and supersede all prior discussions or representations.

Bull God Lawn Care may update these Terms from time to time. Updated Terms will apply prospectively and will be made publicly available.

Maintenance Services – Service-Specific Terms

The following terms apply to recurring lawn and property maintenance Services and supplement the General Terms & Conditions.

Scope & Frequency

Maintenance frequency is selected by the Client; however, Bull God Lawn Care retains sole discretion over actual scheduling, including the timing, sequencing, delay, or skipping of visits due to weather conditions, property conditions, crew availability, or operational considerations.

There is no guaranteed number of maintenance visits per season. While a typical season averages approximately twenty-six (26) visits, actual visit counts may vary.

If mowing is not required during a scheduled visit, Bull God Lawn Care may perform other adjacent maintenance tasks in its place, as determined by the crew lead. Such substitute Services will not exceed the regular maintenance charge unless the Client expressly approves additional work.

Included Services & Seasonal Conditions

Routine maintenance Services may include mowing, trimming, edging, blowing, and minor debris removal, as determined by the crew lead based on site conditions at the time of service.

Additional charges may be incurred if excessive time or labor is required, including but not limited to seasonal leaf accumulation or cleanup conditions. Bull God Lawn Care will act reasonably in assessing such charges.

Grass Height & Turf Conditions

Cut height and mowing practices are determined at the discretion of Bull God Lawn Care unless the Client provides a specific request in advance.

The Client acknowledges that turf health and appearance are affected by factors beyond the Contractor’s control, including weather, watering, soil conditions, prior neglect, and seasonal stress. No guarantees are made regarding turf condition or results; Services are performed using commercially reasonable efforts.

Access & Site Preparation

The Client is responsible for ensuring the property is accessible at the time of service, including:

Providing gate access
Securing pets
Removing toys, furniture, and obstacles
Removing pet waste

If access or site conditions prevent service, Bull God Lawn Care may skip the visit and reschedule at its discretion.

Client Responsibilities & Liability

Client responsibilities related to utilities, irrigation, site conditions, debris, and property preparation are governed by the General Terms & Conditions, which apply fully to maintenance Services.

Pausing or Skipping Service

The Client may request to pause or skip maintenance Services. Such requests are subject to scheduling availability and do not alter billing unless expressly agreed in writing.

Termination of maintenance Services is governed by the Termination section of the General Terms & Conditions.

The following terms apply to fertilization, weed control, and lawn health Services and supplement the General Terms & Conditions.

Scope of Services

Bull God Lawn Care provides fertilization and lawn health Services with the goal of maintaining healthy turf and managing weeds, insects, and other common lawn pests. Services are designed to support overall lawn health and appearance over time, not to guarantee specific results.

Treatments, materials, and application methods are selected at the discretion of Bull God Lawn Care based on seasonal conditions, turf type, and observed site conditions.

Service Frequency

Unless otherwise agreed in writing, fertilization and lawn health Services consist of six (6) visits per season, performed at approximately monthly intervals. Exact service dates may vary based on weather conditions, product requirements, and operational scheduling.

Bull God Lawn Care may adjust the timing, sequence, or type of application as reasonably necessary to account for weather, rainfall, temperature, drought, or other environmental factors.

No Guaranteed Results

The Client acknowledges that lawn health outcomes depend on factors beyond the Contractor’s control, including but not limited to:

Weather and rainfall
Soil conditions
Irrigation practices
Existing turf condition
Mowing practices
Environmental stressors

As a result, Bull God Lawn Care does not guarantee complete weed elimination, pest elimination, or specific turf appearance. Services are performed using commercially reasonable efforts consistent with industry standards.

Access & Site Conditions

The Client is responsible for providing reasonable access to the property for scheduled treatments. Missed or delayed applications due to access issues or unsafe conditions may be skipped or rescheduled at the Contractor’s discretion.

Adjustments & Modifications

Bull God Lawn Care may modify treatment plans, materials, or application timing throughout the season in response to observed conditions in order to best support lawn health. Such adjustments are considered part of the Service and do not constitute a change in scope.

Client Responsibilities

Client responsibilities related to irrigation, mowing, site conditions, utilities, pets, and property access are governed by the General Terms & Conditions and apply fully to fertilization and lawn health Services.

The following terms apply to snow plowing and ice management Services and supplement the General Terms & Conditions.

Scope of Services

Snow and ice management Services may include snow plowing of driveways, parking areas, and access ways, as well as the application of de-icing materials. Services are performed to reduce hazardous conditions, not to eliminate snow or ice entirely.

Unless otherwise agreed in writing, Services are automatically performed when accumulated snowfall reaches approximately two (2) inches or more, without the need for a Client request.

Bull God Lawn Care will furnish the labor, equipment, materials, and supervision reasonably necessary to perform the Services.

De-Icing Materials

De-icing materials may include granular rock salt or equivalent commercial ice melt products, selected at the discretion of Bull God Lawn Care based on conditions.

The Client acknowledges that de-icing materials may cause cosmetic or surface effects to pavement, concrete, turf, landscaping, or surrounding areas. Bull God Lawn Care is not responsible for damage resulting from normal salting or de-icing operations.

Snow Events & Measurement

For each snow or ice event, snowfall accumulation and the determination of whether Services are required shall be made in good faith by Bull God Lawn Care using published third-party meteorological data and local conditions.

Storms separated by approximately twelve (12) hours or storms lasting longer than twenty-four (24) hours may be treated as separate service events for scheduling and billing purposes.

Service Timing & Completion

Completion times are estimates and depend on storm severity, duration, and operational conditions.

Snow events of twelve (12) inches or less are generally completed within fourteen (14) hours of snowfall ending

Snow events exceeding twelve (12) inches may require up to twenty-four (24) hours after snowfall ends

During extended or ongoing storms, interim passes may be performed as conditions allow.

Site Limitations & Access

For safety and equipment limitations, snow removal equipment will not operate closer than approximately ten (10) inches from buildings, vehicles, garage doors, curbing, landscaping, stairs, fences, or other structures.

The Client is responsible for ensuring reasonable access to service areas. Vehicles, obstructions, or unsafe conditions may limit or prevent service. Bull God Lawn Care reserves the right to skip or modify service where access is restricted.

If snow is cleared by others prior to arrival without notice, a trip charge may apply.

Snow Storage & Hauling

During heavy snowfall or repeated storm events, available snow storage areas may become limited. Snow hauling or relocation, if required, is not included unless expressly agreed and will be billed separately.

No Guarantee of Surface Conditions

The Client acknowledges that snow and ice conditions are inherently unpredictable. Bull God Lawn Care does not guarantee bare pavement, ice-free surfaces, or complete prevention of refreezing.

Services are performed using commercially reasonable efforts consistent with industry standards.

Client Responsibilities & Liability

The Client remains responsible for maintaining their own property and liability insurance. Bull God Lawn Care is not responsible for damage to turf, landscaping, pavement, or structures resulting from normal snow removal or de-icing operations.

Client responsibilities regarding site conditions, utilities, and access are governed by the General Terms & Conditions.

The following terms apply to mosquito fogging and insect control Services and supplement the General Terms & Conditions.

Scope of Services

Mosquito fogging Services are intended to reduce adult mosquito populations and other flying insects within treated areas. Services are performed as a population management measure, not as a guarantee of elimination.

Treatments are applied using commercially available insect control products and equipment selected at the discretion of Bull God Lawn Care based on environmental conditions and treatment objectives.

No Guarantee of Results

The Client acknowledges that mosquito populations are influenced by factors beyond the Contractor’s control, including but not limited to:

Weather, rainfall, and wind
Standing water on or near the property
Neighboring properties
Vegetation density
Seasonal population cycles

As a result, Bull God Lawn Care does not guarantee complete mosquito elimination or continuous control between treatments. Services are performed using commercially reasonable efforts consistent with industry standards.

Treatment Frequency

Treatment frequency is determined based on seasonal conditions and Client preference. Exact treatment dates may vary due to weather, wind conditions, product requirements, or operational considerations.

Missed or delayed treatments due to weather or unsafe conditions may be skipped or rescheduled at the Contractor’s discretion.

Environmental & Health Considerations

The Client acknowledges that insect control products are regulated and approved for outdoor use when applied according to label instructions. Bull God Lawn Care applies products in accordance with applicable regulations and manufacturer guidelines.

The Client is responsible for:

Informing Bull God Lawn Care of known sensitivities, allergies, or concerns prior to treatment
Securing pets and people as recommended before and after application
Following any post-treatment instructions provided

Bull God Lawn Care is not responsible for reactions or effects resulting from failure to follow instructions or from conditions outside the treated area.

Weather & Drift

Fogging effectiveness and application safety depend on weather conditions. Bull God Lawn Care reserves the right to delay, modify, or cancel treatments due to wind, rain, or other conditions that could reduce effectiveness or increase drift risk.

Client Responsibilities

Client responsibilities related to access, pets, site conditions, and environmental disclosures are governed by the General Terms & Conditions and apply fully to mosquito fogging Services.
